Blaxteeco operates an online marketplace where users can design and sell their own T-shirts and merchandise.
We strictly prohibit the creation or sale of merchandise that infringes on the intellectual property rights of others, including copyrights, trademarks, and other legal protections.
If you believe that a user on Blaxteeco has violated your intellectual property rights, please follow the procedure outlined below.
A. Reporting Intellectual Property Infringement:
(1) Blaxteeco will take appropriate action, including blocking or removing content (“Content”), if we receive a valid notice indicating a possible infringement of intellectual property rights.
(2) Repeat violations may result in account termination. If you believe that any content on the Blaxteeco platform infringes on your intellectual property rights, please submit an infringement notice including the following details to our designated agent:
- A description of the copyrighted work or intellectual property in question, including any relevant registration numbers if applicable.
- Identification of the infringing content, along with:
- (a) An explanation of how the material is infringing.
- (b) The location of the infringing content on the Blaxteeco platform, with sufficient detail to locate and verify it.
- Your full contact details, including name, mailing address, phone number, and email.
- A statement, made under penalty of perjury, confirming that the use of the copyrighted work or intellectual property is unauthorized.
- A declaration that the information in your notice is accurate and that you are the rights holder or authorized to act on their behalf.
- Your electronic or physical signature.
B. Actions Taken Upon Receipt of an Infringement Notice:
- Blaxteeco will remove or restrict access to the reported content.
- The user responsible for the content will be notified of the action taken.
- Users who repeatedly violate intellectual property laws will have their content removed and their accounts may be permanently terminated.
C. Filing a Counter-Notice:
If you believe your content was mistakenly removed or that you have the right to use it, you may submit a counter-notice with the following information:
- A description of the removed content and where it was located on Blaxteeco before removal.
- A statement, made under penalty of perjury, that you have a good faith belief that the content was removed in error.
- Your full contact details, including name, mailing address, phone number, and email.
- A declaration consenting to the jurisdiction of the Federal Court in your district or, if outside the U.S., the jurisdiction where Blaxteeco is based.
- Your electronic or physical signature.
If a valid counter-notice is received, Blaxteeco may forward it to the original complainant. Unless legal action is taken, the removed content may be restored within 10 to 14 business days.
Please note that under Section 512(f) of the DMCA, anyone who knowingly submits false claims about content infringement may be held liable for damages, including legal fees.
